Regulations Summary

Restrictions

Mangroves are considered forest reserves in Tanzania, and as such restrictions for activities in these reserves apply as follows. No person, other than an existing rightholder exercising an existing right within a forest reserve in respect of which the existing right has been determined shall do any of the following acts:
1.cut done, fell, dig up or remove any tree;
2. dig up or remove any protected wild plant;
3. subject to the provisions of the Beekeeping Act, 2002, harvest, take or remove any other forest produce;
4. enter, perambulate for purposes of tourism or camp within a forest reserve;
5. take and remove any rock, stones, sand, shells or soil;
6. undertake any mining activities;
7. occupy or reside on any land;
8. clear, cultivate, or break up for cultivation or any other purpose, any land;
9. cut, bum, uproot, damage or destroy any vegetation;
10. sow or plant any crops, trees or other vegetation;
11. cut or re-open any saw-pit or work place;
12. erect any buildings or other structures;
13. construct any roads, paths, bridges, railways, waterways or runways;
14. allow any livestock to enter or graze or depasture in any national or local authority forest reserve;
15. hunt, fish, use or be in possession of any trap, snare, net, bow and arrow, gun, poison or explosive substance used or capable of being used for the purposes of hunting or fishing;
16. use any buildings or other structures for any purpose other than a purpose for which it was being used at the time of the declaration of the reserve;
16. carry out any research for which a research permit is required;
17. subject to the provisions of the Beekeeping Act, 2002, collect any honey barrel, hive or other receptacle for the purpose of collecting honey or beeswax;
18. undertake any other activities within a national or local authority forest reserve that is prohibited by regulations applicable to all national forest reserves or any rules applicable to a specific national forest reserve or any by-laws applicable to a specific local authority forest reserve.

Allowed

On and after the declaration of a national or local authority forest reserve as provided under the, the rights to land, trees or forest produce which may be exercised within that national or local authority forest reserve are those rights and only those rights which have been determined to be exercisable in that forest reserve.
