Niue Moana Mahu Marine Protected Area

To provide for the protection of the natural integrity and values of the Niue Moana Mahu Marine Protected Area, generally free from extractive activities, but supporting other reasonable ecologically sustainable use.

Restrictions

The following activities are prohibited:
1. Drift-netting.
2. Use of explosives, firearms, poison or chemicals for fishing.
3. Extractive scientific research by all methods.
4. Deployment of anchored fish aggregation devices.
5. Deployment of drifting fish aggregation devices.
6. Gillnetting.
7. Horizontal multiple hook pelagic and demersal long linning and vertical long linning.
8. All other hook and line fishing.
9. Purse seining.
10. Spear fishing.
11. Trapping.
12. Trawling in all forms.
13. Trolling.
14. Bottom anchoring.
15. Fishing of or around anchored fish aggregation devices.
16. Fishing of or around drifting fish aggregation devices.
17. Installation of moorings.
18. Anchoring of moorings.
19. Aquaculture.
20. Military exercises.
21. Discharge of ballast water.
22. Seabed minning and mineral and oil exploration or extraction.
23. Shellfish harvesting, reef gleaning or dive collecting.
24. Seabed works, dumping of associated spoil or other waste disposal.

Allowed

The following activities are automatic use and entry provisions:
1. General operation or navigation of an aircraft.
2. General operation or navigation of a vessel, ship or submarine, underwater remote control or piloted submersible craft.
3. Commercial and Non-commercial photography, filming, and sound recording.
4. Swimming, snorkeling, and diving.
5. Education programs.
6. Non-extractive scientific or other research and bathymetric surveying.
7. Operating or installing any other facility or structure, only if for the purposes of communications, energy, desalination or other similar service in Niue's national interest.

The following activities may be authorised by the Cabinet, subject to specific conditions:
1. Conducting a tourism operation (only if the operation is non-extractive).
2. Conducting a vessel or aircraft charter or guide operation (only if the operation is non-extractive).
3. Any other purpose that is consistent with the purposes described in regulation 4 of the Niue Moana Mahu Marine Protected Area Regulations 2020.
