Regulations Summary

Restrictions

Equatorial Guinea has sovereign rights for the purpose of exploring and exploiting, conserving and managing the natural resources, whether living or non-living, of these waters. Fishing restrictions, such as bag limits, seasons, and size restrictions apply.

In accordance with Law No. 11/2017, the following conditions apply:
1. The practice of a fishing activity or of any other nature other than that contained in the license is prohibited, including areas not authorized for fishing.
2. Transshipment on the high seas is prohibited, with the exception of vessels that belong to the registries of Regional Fisheries Management Organizations where transshipment on the high seas is authorized, complying with the procedures authorized by the RFMO, or in cases of force majeure.
3. The holder of an artisanal fishing authorization of any kind shall refrain from participating in fishing activities beyond 6 nautical miles from the baseline from which the width of the territorial sea is measured.
4. Fishing activity is prohibited in any area outside of those listed in the license or authorization as qualified for fishing.
5. For security reasons, it is prohibited to enter the security zone of mobile, fixed and floating installations used for hydrocarbon exploration and production operations within 500 meters for artisanal fishing and 3 nautical miles for semi-industrial and industrial fishing, or at such distances as may be determined by the competent authority.
6. The competent Minister shall set in the Fisheries Management Plans, the type of fishing nets, including the minimum sizes of fishing meshes and prohibited fishing meshes.
7. Industrial and semi-industrial trawling will be prohibited in the 12-mile zone with respect to the baseline. Artisanal trawling gear will be regulated by technical standards defined in the fishing management plans.
8. The transfer of fishery products between fishing vessels and from fishing vessels to transport or processing vessels, as well as the transshipment of products from fishing, on the high seas, with exceptions and in the cases contemplated in article 21, shall be prohibited.
