Purpose
In 2001, after the delimitation of maritime borders and establishment of the EEZ, Nigeria and São Tomé and Príncipe signed a treaty for the Joint Exploration of Petroleum Resources and others existing in the Joint Zone of the two States.

Restrictions
In accordance with Articles 74 and 83 of the United Nations Convention on the Law of the Sea, the delimitation of the continental shelf between States with opposite or adjacent coasts shall be effected by agreement on the basis of international law, as referred to in Article 38 of the Statute of the International Court of Justice, in order to achieve an equitable solution. The States concerned, in a spirit of understanding and cooperation, shall make every effort to enter into provisional arrangements of a practical nature and, during this transitional period, not to jeopardize or hamper the reaching of the final agreement. Such arrangements shall be without prejudice to the final delimitation.
In accordance with Article 3 of the Treaty between the Federal Republic of Nigeria and the Democratic Republic of São Tomé and Príncipe, there shall be joint control by the States Parties of the exploration for and exploitation of resources, aimed at achieving optimum commercial utilization. The States Parties shall share, in the proportions Nigeria 60 per cent, São Tome and Principe 40 per cent, all benefits and obligations arising from development activities carried out in the Zone in accordance with this Treaty. No development activities shall be conducted or permitted in the Zone except in accordance with this Treaty.
