Purpose

To ensure the conservation of marine environments, the water column and seamounts and their species of fauna, flora and microorganisms, particularly endangered and endemic species present in the Archipelago of São Pedro and São Paulo.

Regulations Summary

Restrictions

1. The retention, transport and/or sale of species threatened with extinction, defined as such in an official national list, is prohibited, and their immediate return to the sea, alive or dead, is mandatory.
2. Fishing activity in the overlapping area between the São Pedro and São Paulo Archipelago Environmental Protection Area and the Fernando de Noronha Environmental Protection Area - Rocas e - São Pedro and São Paulo, which totals about 8,350 hectares, is subject to the following rules:
a) In this Zone, spearfishing may only be authorized as a method of collecting and capturing in research activities and when duly authorized by the Biodiversity Information and Authorization System (SISBIO) and other competent bodies, when applicable.
b) The following is prohibited, except for scientific research purposes:
i. The capture of all demersal and benthic species of marine organisms;
ii. The capture of all species of elasmobranchs;
iii. The capture of any species that is not expressly permitted.
c) Fishing with a trawl or gillnet or longline of any nature, or using any other fishing gear that is not expressly permitted, is prohibited.

Allowed

1. Fishing carried out only by duly authorized fishing vessels is permitted, according to the permitting system defined by Interministerial Normative Instruction MPA/MMA No. 10, of June 10, 2011, and which operate in the modalities of surface horizontal longline, surface handline and trolling.
2. All vessels, in order to carry out fishing activities in the Environmental Protection Area of ​​the São Pedro and São Paulo Archipelago, must comply with the specific legislation on each subject and are obliged to:
a) be duly authorized by competent managing bodies;
b) use the satellite tracking equipment installed on board the vessel, regardless of the vessel's size, pursuant to the National Fishing Vessel Tracking Program-PREPS;
c) deliver the duly completed onboard maps containing all catches, including incidental and endangered species, to competent bodies and a copy to ICMBio;
d) longline vessels may not use steel slings or any other material other than monofilament nylon in their fishing gear, unless specifically authorized;
e) fishing vessels in longline modalities must use a circular hook, consisting of circular hooks, made of metal, without a ring, with a tip turned towards the rod, whose size is equal to or greater than 14/0.
3. Fishing is permitted with a hand line, troll or puçá, or hand net, for albacores of the genus Thunnus, Wahoo (Acanthocybium solandri), oilfish (Ruvetus pretiosus), flying fish, dourado, barracuda and anchovy in the overlapping area between the São Pedro and São Paulo Archipelago Environmental Protection Area and the Fernando de Noronha Environmental Protection Area - Rocas e - São Pedro and São Paulo.
