Regulations Summary

1. The following is prohibited in the marine area of the Natural Park:
a) Any action that may cause a substantial and irreversible modification of the environmental characteristics both in the intertidal and marine space.
b) Underwater fishing in inland waters, fishing with trawling gear, purse seine gear and fixed or drifting gear that do not comply with the provisions of current fishing regulations.
c) The collection of marine organisms with the exceptions established in article 52 of Law 42/2007, of December 13, on Natural Heritage and Biodiversity and the current fishing regulations regarding inland waters.
d) The anchoring of vessels weighing more than 75 tons.
e) The anchoring of vessels of less than 75 tonnes outside those spaces that are considered stable anchoring areas in the PRUG, except in the case of adverse weather conditions.
2. The following are prohibited for the development of public use activities:
a) The circulation of vehicles on forest roads and tracks at speeds exceeding 40 km/h, unless expressly indicated to the contrary.
b) Hot air ballooning in Reserve Areas and parachuting throughout the Natural Park.
c) Cross-country or off-road circulation, with bicycles, motor vehicles and on horses.
d) The holding of motorized land vehicle sports events on any road in the Natural Park, except on regional roads.
e) Motorboating activities, except on urban beaches in areas marked for this purpose.
f) Camping and permanent or temporary parking outside tourist camps and camping areas, between sunset and sunrise, of vehicles used as dwellings, and the construction of dwellings with any type of materials.
g) Activities related to recreational activities that use helicopters, ultralights, airplanes, light aircraft and any motorized aerial vehicle.
h) The circulation of quads in activities linked to public use.
3. Research activities that imply serious, temporary or permanent, deterioration of the natural and cultural values of the Natural Park are prohibited.
4. Any action that involves a substantial modification of the characteristics of these areas, such as the opening of new communication routes, port infrastructure, tourist camps and the construction of buildings for residential and hotel use, is prohibited.
5. Any work or installation that generates a substantial modification of the current coastal dynamics and consequently alters the current morphology of beaches and cliffs is prohibited.
6. The following are prohibited in the Natural Park:
a) The development of activities that generate significant emissions of suspended particles on a temporary or permanent basis.
b) The installation of information signs or commemorative elements supported or built on natural elements of the landscape, such as rocks, trees, slopes, areas or enclaves of singular landscape interest, as well as graffiti and similar on natural elements, with the exception of certain symbols related to the public use of the space.
c) The installation of golf courses.
d) New research and exploitation activities for mineral deposits and other geological resources, except for salt mining and those operations that currently carry out their activity in accordance with current regulations and until their current authorisations expire. No new permits or concessions will be granted for this type of activity.
e) The drying, filling, silting up or draining of ponds, lagoons, marshes, salt flats or any other type of natural or artificial wetland, whether temporary or permanent. Work inherent to salt-mining activities shall be excluded.
7. When carrying out aeronautical activities considered compatible: paragliding, hang gliding, motorless flight and hot air ballooning, flying within 500 metres of nesting and breeding sites of birds of prey is prohibited from 1 December to 31 August, as well as in areas expressly excluded by application of regulations for the protection of wild species and habitat.
8. In addition, the following guidelines apply:
Regulation of kayaking, paddle surfing and similar activities
a) If you choose to do a route with one of the active tourism companies in the Natural Park, they are aware of and apply the existing regulations, please comply with their instructions, they are necessary to be able to develop a responsible and sustainable tourist activity.
b) If you decide to do the activity on your own with a floating device of this type or similar (whether it is your property or rented), you must be aware of the following regulations:
i. In the event that a group of more than 5 devices is going to do it,
it is necessary to have authorization from the Natural Park, which will
specify the conditions under which the activity can be carried out to guarantee the conservation of the space.
ii. When the number of artifacts is lower, the development of the
activity will be carried out taking into account the following
considerations:
- Boarding and disembarking from the natural beaches of the Natural Park (B3 zones), will be carried out taking into account that it is a Maritime Terrestrial Public Domain, free to use and enjoy by all users, so respect everyone who is enjoying the same beach as you.
- When you want to approach the A2 Marine Reserves areas of the Natural Park, as it is a fragile ecosystem, remember that only transit through them is permitted and always do so taking care of the high ecological and geological value that has made these areas an integral reserve. Help preserve them.
Regulation of recreational boat anchoring
Anchoring is prohibited in the A2 Marine Reserves areas of the Cabo de Gata - Níjar Natural Park.
a) In the properly marked bathing areas, located in the B4 Urban Beaches areas, recreational and sports navigation and the use of any type of boat or floating means powered by sail or motor will be prohibited. The launching or beaching of boats must be done through properly marked nautical channels.
b) On unmarked beaches, navigation and anchoring may only be done outside the bathing areas, considered as such the one that occupies a strip of sea adjacent to the beach with a width of 200 meters (50 meters in cliff areas).
c) In accordance with the provisions of the Master Plan for Use and Management, anchoring will not be done on rocky bottoms or on bottoms that host communities of marine phanerogams, or in those places where there are alternative fixed anchoring points (San José Sports Port).
d) At present there is no regulated buoy field that offers rental of anchorages within the Natural Park. The installation of permanent anchoring points requires authorization. There are only about twenty buoys for use by diving centers that have the main rules of use printed on them. If you have to moor in an emergency situation, check that you can comply with the established regulations.
e) If you do anchor, make sure you comply with these restrictions and do so responsibly and with the least possible impact on the environment.
Allowed
In general, traditional uses of the Park are encouraged. This includes artisanal fishing throughout the Park and saline activities in the wetlands and coastal lagoon habitats.
The following activities require prior authorization from the competent Ministry of the Environment:
1. the introduction, transfer, and release of living individuals of marine species in inland waters;
2. the implementation of new facilities dedicated to the culture of fish, crustaceans, or molluscs.
